Terms of service
General Terms and Conditions of Meisterpilze UG (haftungsbeschränkt)
§ 1 Scope and definitions
(1) The following General Terms and Conditions apply, in the version valid at the time of the order, to all deliveries between us and a consumer. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 of the German Civil Code, BGB).
§ 2 Conclusion of a contract, storage of the contract text
(1) The following provisions on the conclusion of the contract apply to orders placed through our online shop https://www.meisterpilze.com.
(2) Where a contract is concluded, it is concluded with Meisterpilze UG (haftungsbeschränkt), Pommernstraße 13a, 91052 Erlangen, Germany, e-mail: team@meisterpilze.de. Registration court: Local Court (Amtsgericht) Fürth, HRB 21223.
(3) The presentation of goods in our online shop does not constitute a legally binding offer, but a non-binding invitation to order goods. By placing an order, the consumer makes a binding offer to conclude a contract of sale.
(4) The order is placed in the following steps: selecting the item and, where applicable, the variant; clicking “Add to cart”; reviewing the cart; “Check out”; entering the contact and delivery details (as a guest or with a customer account); selecting the shipping method and the payment method; a final summary showing the total price including shipping costs; binding submission of the order by clicking the final order button at the end of that summary. Up to that point you can correct your entries at every step of the checkout using the change links offered there. We confirm receipt of the order immediately by an automatically generated e-mail; by that e-mail we accept the offer.
(5) We send you the order details and our Terms and Conditions by e-mail. The Terms and Conditions can be viewed at any time at meisterpilze.com/policies/terms-of-service. For security reasons, the order details are no longer accessible via the internet.
§ 3 Prices, shipping costs, payment, due date
(1) The prices stated are total prices and include statutory VAT. Additional shipping costs are stated with the respective offer and in our shipping policy and are shown separately before the order is placed.
(2) The consumer may pay by credit or debit card (including Visa, Mastercard, American Express, Maestro), by Apple Pay, Google Pay or Shop Pay (each processed via Shopify Payments) and by PayPal. Which payment methods are available in an individual case is shown at checkout before the order is placed.
§ 4 Delivery
(1) We deliver to delivery addresses in Germany, Austria, Italy, Denmark and Sweden. We produce to order: substrates, grain spawn and comparable sterile products are freshly autoclaved after the order has come in. The processing time is usually one to two working days; delivery takes place within no more than five working days to Germany, seven working days to Austria and ten working days to Italy, Denmark and Sweden. The period begins on the day after the contract is concluded; if the end of the period falls on a Saturday, Sunday or a public holiday at the place of delivery, it ends on the next working day. Differing information given with the individual item takes precedence.
(2) Fresh, highly perishable and living goods (e.g. fresh mushrooms, liquid cultures, living cultures) are shipped by us in such a way that they arrive in perfect condition; the shipping method and shipping days may differ. Please accept such shipments without delay and check them immediately.
(3) The risk of accidental loss and deterioration passes to the buyer only upon handover, including in the case of a sale involving carriage.
§ 5 Retention of title
We retain title to the goods until the purchase price has been paid in full.
§ 6 Right of withdrawal for consumers
Instructions on withdrawal
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquired physical possession of the goods. To exercise the right of withdrawal, you must inform us, Meisterpilze UG (haftungsbeschränkt), Pommernstraße 13a, 91052 Erlangen, Germany, e-mail: team@meisterpilze.de, of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods.
End of the instructions on withdrawal
Exclusion and early expiry of the right of withdrawal
The right of withdrawal does not exist, or expires early, for the following contracts:
- for the supply of goods which are liable to deteriorate or expire rapidly (§ 312g(2) no. 2 BGB). This applies in particular to fresh mushrooms and other fresh, perishable produce.
- for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (§ 312g(2) no. 3 BGB). This applies in particular to sterile or sterilised substrates, grain spawn, liquid cultures as well as syringes, syringe filters and comparable sealed cultivation products supplied sterile; the right of withdrawal expires when the seal is removed or the injection port is opened.
§ 7 Model withdrawal form
(If you wish to withdraw from the contract, please fill in this form and send it back.)
